Please note: Most residential leases in the Northern Territory are covered by the Residential Tenancies Act 1999.

TYPES OF RESIDENTIAL TENANCY AGREEMENTS

There are two types of residential tenancy agreements: a fixed term residential tenancy agreement and a periodic agreement.  This form can be adapted for either a periodic or fixed tenancy.   A fixed term residential tenancy is an agreement between a landlord (also referred to as a lessor) and a tenant for a specific period of time, usually for six months or one year.  A 12 month residential tenancy agreement is the most commonly used fixed term agreement.   A periodic agreement or tenancy is for a recurring period without a fixed term. This can continue for as long as necessary until one party decides to end the relationship. A month-to-month residential tenancy agreement is an example of a periodic tenancy.  Periodic leases automatically start at the end of a fixed term.

CONDITION REPORT

At the beginning of the tenancy the landlord fills out and signs 3 copies of the condition report, two of which will be provided to the tenant. The tenant indicates agreement or disagreement with the condition suggested by the landlord or landlords agent by placing a tick or a comment in the correct space. The tenant must return one signed copy of the completed condition report to the landlord or landlords agent within (3) business days and retains the second copy.

START OF A TENANCY

The landlord is required by legislation to provide certain documents to the tenant. These are:

    A statement of rights and duties of a landlord and tenant under a tenancy agreement.
    

Contact details of the landlord or where there is an agent, the agents details.
    A condition report (2 copies) of the property, unless there is no bond required. [Attached to this Agreement]
    A copy of the bond lodgement form (unless there is no bond required).
    A copy of the agreement (where it is in writing) and receipt for the rent paid.

A bond must be lodged with the Commissioner of Tenancies within seven (7) business days.

Landlords can legitimately claim certain costs from tenants including rent in advance or gas and electricity charges where the premises have a separate meter.

Legal fees associated with the tenancy agreement cannot be claimed from the tenant.

The Commissioner of Tenancies has a Residential Tenancies List that deals with disputes relating to tenancies. Application forms and further information can be obtained from the Department of Justice  Northern Territory Government website

It is agreed that the Landlord grants to the Tenant for value a right of occupation of the premises for use as a residence by the Tenant in accordance with this Tenancy Agreement (including the terms of the tenancy under this Tenancy Agreement).

6.   RENTAL BOND (optional)

The Tenant must pay a rental bond of $_______[ a maximum of four (4) weeks rent] to the Landlord or the Landlords Agent on or before signing this Agreement.
The Landlord must:
(a)   on receiving the bond, the Landlord must give the Tenant a receipt for the bond;
(b)   the Landlord must complete and sign the bond lodgement form (“Lodgement of Security Bond”) and the Tenant must do the same;
(c)   the Landlord or Agent must lodge the bond and bond lodgement form with the Commissioner of Tenancies  within seven (7) days of receiving the bond, or the commencement of the tenancy, whichever date is the later.
(d)   the Landlord must lodge the bond whether or not the Tenant completes the bond lodgement form.


7.   CONTINUATION

At the end of the Term the Tenant can stay in the Premises at the same rent (or an increased rent if rent increases in accordance with Residential Tenancies Act 1999) but otherwise under the same terms unless or until the Agreement is ended in accordance with the Residential Tenancies Act 1999. Landlord must give Tenant a thirty (30) days notice prior to increasing rent.

8.    RENT AND BOND ONLY AS PAYMENT FOR THE TENANCY
The Landlord must not require any payment other than rent or bond for the following:
(a)   the granting, extension, transfer or renewal of a tenancy or subtenancy;
(b)   vacating of premises;
(c)   obtaining a key to the premises;
(d)   information on the availability of tenancies.

9.   HOLDING DEPOSITS
The Residential Tenancies Act prohibits the taking of holding deposits.
10.   PAYMENT OF RENT
(a)   The Tenant must pay the rent on time.  
(b)   The Tenant must not use the bond money to pay the rent for the last weeks of the tenancy.
(c)   The Tenant and the Landlord may agree to change the way rent is paid (including, for example, where the rent is paid or whether it is to be paid into a nominated bank account or whether it is to be paid in person).
(d)   The Tenant and Landlord may agree that rent is to be paid electronically.
11.   MAXIMUM RENT IN ADVANCE
Tenant may be required to pay two (2) weeks rent in advance during the first fortnight of the tenancy.

12.   CONDITION OF THE PREMISES

The Landlord's Agent shall ensure that the premises are maintained in good repair.

13.   HANDING OVER VACANT POSSESSION WITHOUT LEGAL IMPEDIMENT

At the commencement of the Agreement the Landlord will hand over vacant possession of the premises to the Tenant (except for any part reserved for the Landlords own use set out on the front page of this document). When handing over vacant possession the Landlord agrees that there is no legal impediment (either known or that should reasonably be known) that would prevent the Tenant from using the premises as a residence for the term of the tenancy.

14.    DAMAGE TO THE PREMISES

(a)   The Tenant shall make sure that care is taken to avoid damaging the premises.
(b)   The Tenant shall give notice to the Landlord's Agent of any damage to the premises as soon as the Tenant becomes aware of the damage.
(c)   In the event of a breakdown of ANY of the appliances - or in the event that maintenance of any type becomes necessary at the property it is an obligation of the Tenant to NOTIFY the Landlord's Agent IMMEDIATELY before any repairs are commenced.
(d)   The Tenant is responsible for any damage incurred by people who come to the premises. The Tenant is responsible for any consequent cleaning and repair of carpets, walls drapes, cupboards and doors, and for the maintaining of noise levels acceptable to neighbours.
(e)   The Landlord or the Landlord's Agent shall not be obliged to re-instate the premises in the event that the premises are destroyed totally or to an extent as to be rendered unsafe.

15.    CLEANLINESS OF THE PREMISES

(a)   The Landlord's Agent shall make sure that the premises are in a reasonably clean condition on the day on which it is agreed that the Tenant shall enter into occupation of the premises.
(b)   The Tenant shall keep the premises in a reasonably clean condition during the period of the agreement.
(c)   The Tenant shall deposit all rubbish including cartons and newspapers in the proper rubbish receptacles as required by the local Council.
(d)   The Tenant agrees to have the carpets professionally steam cleaned at their cost upon the Tenant's vacation of the property.
(e)   The Tenant shall:-
i.   Put bins out weekly for clearance (and return);
ii.   Mow lawns at property;
iii.   Weed Garden at property;
iv.   Sweep and generally tidy up property;
v.   Generally keep property tidy

16.    REPAIR OF THE PREMISES

The Landlord or its contractors may enter the premises to carry out structural repairs and/or improvements deemed necessary by the Landlord, where 24 hours prior notice has been provided to the Tenant. In the event that any statutory permits are required the Landlord will comply with such requirements, prior to any works being undertaken.

17.   URGENT REPAIRS DURING A TENANCY

Tenant must notify Landlord as soon as possible if there are any repairs required. Urgent repairs are classed as:
   a dangerous electrical fault
   a failure of gas, electricity or water supply to the property
   flooding or serious flood damage
   serious storm or fire damage
   a gas leak
   a burst water service
   a blocked or broken lavatory system
   a serious roof leak
   a failure or breakdown of any service or appliance on the property essential for hot water, cooking, heating or laundering
   an appliance, fixture or fitting which is not working properly and causes a substantial amount of water to be wasted
   a fault or damage that causes the residential property to be unsafe or insecure
   a serious fault in any door, staircase, lift or other common area
   a fault or damage likely to cause injury to person or property.

If Landlord fails to carry out these repairs or refuses to do so then Tenant can have the work done by a licensed tradesperson (if nominated tradesperson is not available ) by choosing the lowest of two (2) quotes available from such two(2) tradesperson . However the tenant can only claim costs that are equal or less than two (2) weeks rent.


18.    PERIODIC MAINTENANCE INSPECTION OF THE PREMISES

The Landlords Agent shall undertake periodic maintenance inspections, of the premises on a six monthly basis. The Landlords Agent shall provide seven (7) days notice to the Tenant prior to undertaking such inspection.

19.   ALTERATION OF PREMISES

The Tenant shall not undertake any structural or other alterations to the premises.

20.    USE OF THE PREMISES

(a)   The Tenant shall not use or allow the premises to be used for any illegal purpose.
(b)   The Tenant shall not use or allow the premises to be used in such a manner as to cause a nuisance.
(c)   The Tenant shall not paint or affix any sign or any antenna onto the premises or affix any nail, screw fastening or adhesive to the interior of the premises without the prior written consent of the Landlord's Agent, which consent shall not be unreasonably withheld.
(d)   The Tenant shall not keep or use in the premises any portable kerosene heaters, oil burning heater or heaters of a similar kind.
(e)   The Tenant shall not keep any animal, bird or pet on the premises without the written consent of the Landlord's Agent

21.    QUIET ENJOYMENT

The Landlord's Agent shall take all reasonable steps to make sure that the Tenant has quiet enjoyment of the premises.

22.   ASSIGNMENT OR SUB-LETTING

The Tenant has the right, with the Landlords written approval, to sublet the rental premises, or assign their interest to another party. The Landlord cannot unreasonably withhold consent or charge for subletting or assignment, except for reasonable incidental expenses in doing so.

23.   RESIDENTIAL TENANCIES ACT

Both parties to this Agreement shall comply with the provisions of the Residential Tenancies Act 1999 as they apply to each party.

24.   PAYMENT OF COUNCIL RATES, WATER RATES, LAND TAX AND OTHER CHARGES
(a)   Landlord agrees to pay:
i.   council rates;
ii.   for water, other than water that the Tenant has agreed to pay for under clauses 24 b.iii and 24 b. iv of this agreement;
iii.   land taxes;
iv.   the cost of installing any meters to measure the supply of water, electricity or gas; and
v.   charges under any other Act for the residential premises.

(b)   The Tenant agrees to pay:
i.   for electricity;
ii.   for gas;
iii.   for excess water used during the term of this agreement;
iv.   any other charge for water set out in the additional terms of this agreement if the charge for
v.   water is calculated according to the metered amount of water consumed and there is no
vi.   minimum rate chargeable;
vii.   any excess garbage or sanitary charges; and
viii.   any charges for pumping out a septic system.

25.   LANDLORD'S RIGHT OF ENTRY

The Landlord may, enter the premises in the following circumstances: 
(a)   in the case of an emergency; (no notice is required)
(b)   to complete a condition report; (twenty four (24) hours notice must be given).
(c)   by giving written notice, with a date and time specified, to the Tenant for a specific purpose (including routine inspections of the premises) seven (7) to fourteen (14) days before entering the premises; (not more frequently than once every four (4) weeks for routine inspections)
(d)   at a previously arranged time with the Tenant, but not more than once every week for the purpose of collecting rent;
(e)   to carry out necessary repairs or maintenance at a reasonable time, giving at least twenty four (24) hours written notice;
(f)   after giving reasonable notice (minimum twenty four (24) hours) to the Tenant to show the premises to prospective Tenants during the last twenty eight (28) days of a tenancy;
(g)   after giving reasonable notice to the Tenant to show the premises to prospective purchasers; (it is generally accepted that inspections by appointment for the purpose of showing the premises to prospective purchasers should be no more than twice weekly, with at least twenty (24) hours. notice being given and that open inspections should be no more than once per fortnight with reasonable notice being given);
(h)   at any time with the consent of the Tenant given immediately before the time of entry.


26.   INSURANCE

(a)  The Tenant shall not do or allow anything to be done which would invalidate any insurance policy on the premises or increase the premium and the Tenant shall pay to the Landlord's Agent all increased premiums and other expenses incurred as a consequence of any breach of this term.
(b)  Tenant agrees to pay the Landlords Agent any excess premium imposed by the Landlords insurance company in the event of damage to the premises or its fitting and fixtures.

27.   INDEMNIFICATION

(a)   The Tenant shall indemnify the Landlord's Agent for any loss or damage caused by failure to ensure that care is taken to avoid damaging the rented premises by the Tenant or its servants, agents, invitees or any other person on the premises with the consent of the Tenant. Without limiting the generality of the foregoing, the Tenant shall indemnify the Landlord's Agent for the cost of repairs to plumbing blockages caused by the negligence or misuse of the Tenant.
(b)   The Tenant shall notify the Landlord's Agent immediately upon becoming aware of any defects in the premises or any other matter which may give rise to a liability pursuant to common law in Northern Territory.
(c)   The Tenant shall indemnify the Landlord against all liability in respect of injury or damage to any third person or third party property arising from any conduct, act or omission by the Tenant, his servants, agents and/or invitees.

28.   TERMINATION.

(a)   Either the Landlord or the Tenant may terminate the tenancy by Notice of Breach of Agreement given to the other for breach of any term of the Agreement. Such notice is to be in the written form required by regulation, specifying the breach and informing the Tenant or Landlord that if the breach is not remedied within a specified period (which must be a period of at least fourteen (14) clear days) from the date the notice is given, then the tenancy is terminated by force of the notice.
(b)   Where termination is sought by the Landlord on the grounds of non-payment of rent, one (1) days of unpaid or part-paid rent must elapse before a termination notice can be issued. Landlord must complete a “Notice of termination for non-payment of rent” form giving seven (7) days to Tenant to pay outstanding rent failing which Landlord has the sole right to making an application to the Magistrates Court.
(c)   If the premises has become uninhabitable or been unavailable for more than three (3) days because of flooding either the Landlord or the Terminate can terminate the agreement by giving two (2) days notice to the other.
(d)   Either the Landlord or the Tenant can also give two (2) days notice to terminate the Agreement to the other if continued occupation of the premises is a risk to the health and safety of the Tenant or another member of the public or a threat to the safety of the property.
(e)   If the tenancy is a periodic tenancy the Landlord must give forty two (42) days notice to end the Agreement.
(f)   If the Tenant intends to vacate the premises before the expiration of term for serious reasons like loss of job, illness, job relocation or threat of violence, Tenant may give Landlord a prior written of twenty (21) days. However the tenant may still be responsible for rent until the landlord can find replacement tenants and for advertising costs.
(g)   Where the tenancy is periodic (no fixed term), the tenant must give at least fourteen (14) days notice in writing.
(h)   Upon the termination of the agreement the Tenant shall deliver the keys to the premises to Landlord at a mutually agreed time. The Tenant agrees to continue paying rent until the keys are delivered.
(i)   If the Tenant remains in occupation of the premises following the expiration of the agreement, the Tenant shall be deemed to be a monthly Tenant on the basis of the terms and conditions contained in the agreement to the extent to which such terms and conditions shall be applicable to a periodic tenancy.

29.   WAIVER.

No consent or waiver of any breach by the Tenant of the Tenant's obligations under the
Residential Tenancy Act, 1999 shall prevent the Landlord from subsequently enforcing any of the provisions of this Agreement.

30.   ENTIRE AGREEMENT; MODIFICATION.

This Agreement is the final, complete and exclusive agreement of the parties with respect to the subject matter hereof. This agreement may be amended by agreement in writing and signed by both the Landlord and the Tenant.

CONDITION OF PREMISES REPORT

The landlord/agent must provide the Condition of Premises Report to the tenant no later than the day after handing over the premises. The tenant/s should check the report carefully and note any points of disagreement before signing and return it to the landlord/agent within 3 days.  It is also recommended that all parties retain a copy of the report for their records.
