Residential Tenancy Agreement 8 IN WITNESS WHEREOF the parties hereto have hereunto set their hands the day and year first hereinbefore w. 30. ENTIRE AGREEMENT; MODIFICATION. This Agreement is the final, complete and exclusive agreement of the parties with respect to the subject matter hereof. The (i) Where the tenancy is periodic (no fixed term), the tenant must give at least twenty one (21) days notice in writing, or a period equivalent to one rental period (whichever is longer) specifying ts been signed, Landlord may give Tenant four (4) weeks' notice. (h) Either the Landlord or the Tenant may give the other at least sixty (60) days notice of termination to terminate a periodic tenancy.Either the Landlord or the Tenant may give the other at least fourteen (14) days notice of termination to terminate a fixed tenancy. (g) If the agreement is a periodic agreement and a sale contract ha, the other party may give the party seven (7) days notice. (e) If premises are required for a compulsory acquisition, either the Landlord or the Tenant may give the other sixty (60) days notice. (f) rent. (b) Where termination is sought by the Landlord on the grounds of non-payment of rent, one (1) days of unpaid ed by regulation, specifying the breach and informing the Tenant or Landlord that if the breach is not remedied within a specified period (which must be a period of at least fourteen (14) clear days) ther the Landlord or the Tenant may terminate the tenancy by `Notice of Breach of Agreement' given to the other for breach of any term of the Agreement. Such notice is to be in the written form requirge to any third person or third party property arising from any conduct, act or omission by the Tenant, his servants, agents and/or invitees. 28. TERMINATION. Residential Tenancy Agreement 7 (a) Eithe premises or any other matter which may give rise to a liability pursuant to common law in Queensland. (c) The Tenant shall indemnify the Landlord against all liability in respect of injury or damagent for the cost of repairs to plumbing blockages caused by the negligence or misuse of the Tenant. (b) The Tenant shall notify the Landlord's Agent immediately upon becoming aware of any defects in nant or its servants, agents, invitees or any other person on the premises with the consent of the Tenant. Without limiting the generality of the foregoing, the Tenant shall indemnify the Landlord's A fixtures. 27. INDEMNIFICATION (a) The Tenant shall indemnify the Landlord's Agent for any loss or damage caused by failure to ensure that care is taken to avoid damaging the rented premises by the Teuence of any breach of this term. (b) Tenant agrees to pay the Landlord's Agent any excess premium imposed by the Landlord's insurance company in the event of damage to the premises or its fitting anddone which would invalidate any insurance policy on the premises or increase the premium and the Tenant shall pay to the Landlord's Agent all increased premiums and other expenses incurred as a conseqight with reasonable notice being given); (h) at any time with the consent of the Tenant given immediately before the time of entry. 26. INSURANCE (a) The Tenant shall not do or allow anything to be showing the premises to prospective purchasers should be no more than twice weekly, with at least twenty (24) hours. notice being given and that open inspections should be no more than once per fortnht (28) days of a tenancy; (g) after giving reasonable notice to the Tenant to show the premises to prospective purchasers; (it is generally accepted that inspections by appointment for the purpose ofat least twenty four (24) hours written notice; (f) after giving reasonable notice (minimum twenty four (24) hours) to the Tenant to show the premises to prospective Tenants during the last twenty eig(d) at a previously arranged time with the Tenant, but not more than once every week for the purpose of collecting rent; (e) to carry out necessary repairs or maintenance at a reasonable time, giving ific purpose (including routine inspections of the premises) seven (7) to fourteen (14) days before entering the premises; (not more frequently than once every four (4) weeks for routine inspections) ) to complete a condition report; (twenty four (24) hours notice must be given). Residential Tenancy Agreement 6 (c) by giving written notice, with a date and time specified, to the Tenant for a spec charges for pumping out a septic system. 25. F COUNCIL RATES, WATER RATES, LAND TAX AND OTHER CHARGES (a) Landlord agrees to pay: i. council rates; ii. for water, other than water that the Tenant has agreed to pay for under clauses 24 b.iii and tal expenses in doing so. 23. RESIDENTIAL TENANCIES ACT Both parties to this Agreement shall comply with the provisions of the Residential Tenancies Act 1994 as they apply to each party. 24. PAYMENT Oroval, to sublet the rental premises, or assign their interest to another party. USE OF THE PREMISES (a) The Tenant shall not use or allow the premises to be used for any illegal purpose. ALTERATION OF PREMISES The Tenant shall not undertake any structural or other alterations to the premisesto be reimbursed. 18. PERIODIC MAINTENANCE INSPECTION OF THE PREMISES The Landlord's Agent shall undertake periodic maintenance inspections, of the premises on a six monthly basis. The Landlord's Agedo so then Tenant can have the work done by a licensed tradesperson upto a maximum value equivalent to 2 weeks rent. Tenant shall to pay the tradesperson and then put a request in writing to Landlord secure · a serious fault in any door, staircase, lift or other common area · a fault or damage likely to cause injury to person or property. URGENT REPAIRS DURING A TENANCY Residential Tenancy Agreement 4 Tenant must notify Landlord as soon as possible if there are any repairs required. REPAIR OF THE PREMISES The Landlord or its contractors may enter the premises to carry out structural repairs and/or improveam cleaned at their cost upon the Tenant's vacation of the property. Weed Garden at property; iv) The Tenant shall deposit all rubbish including cartons and newspapers in the proper rubbish receptacles as required by the local Council. (d) The Tenant agrees to have the carpets professionally stethe day on which it is agreed that the Tenant shall enter into occupation of the premises. (b) The Tenant shall keep the premises in a reasonably clean condition during the period of the agreement. (cmises are destroyed totally or to an extent as to be rendered unsafe. 15. CLEANLINESS OF THE PREMISES (a) The Landlord's Agent shall make sure that the premises are in a reasonably clean condition on upboards and doors, and for the maintaining of noise levels acceptable to neighbours.
